Stepparent Adoption
Stepparent adoption is adoption that takes place when a spouse remarries after a divorce or after a spouse dies, and the new spouse agrees to adopt the child and legally assume parental responsibilities.
In Colorado, in order to adopt as a stepparent, the person must be 21 years of age, married for at least one year to the parent of the child, and the child, parent and stepparent must be residents of Colorado. The parent and stepparent may also need to show that the other biological parent has “abandoned” the child emotionally and financially for over a year.
A family law attorney can ensure all necessary documentation is filed in the proper court system, meeting all legal requirements in filing for stepparent adoption. After the adoption request has been filed, within the next two months, the court will assign a hearing date.
