Abuse & Neglect

Child abuse and neglect is defined under federal law in the Child Abuse Prevention and Treatment Act as “the physical and mental injury, sexual abuse, negligent treatment, or maltreatment of a child under the age of 18 by a person who is responsible for the child’s welfare under circumstances which indicate that the child’s health or welfare is harmed or threatened.”

Colorado statutes also graphically define child abuse through specific examples in which these conditions are not justifiably explained, nor result from an accident, such as evidence of the following:

  • Skin bruising
  • Bleeding
  • Malnutrition
  • Failure to thrive
  • Burns
  • Fracture of any bone
  • Subdural hematoma (blood collection between the surface of the brain and its outermost covering)
  • Soft tissue swelling
  • Death

Other examples of abuse and neglect include the following:

  • Subjecting the child to unlawful sexual behavior
  • Failure to provide adequate food, clothing, shelter, medical care or supervision that a prudent parent would take
  • Subjecting the child to emotional abuse, which is identifiable and results in substantial impairment of the child’s intellectual or psychological functioning or development
  • Manufacturing or attempting to manufacture controlled substances in the presence of the child, premises where the child is found, or where a child resides
